The Delhi High Court on Wednesday sought response from the National Investigation Agency (NIA) on a plea seeking treatment of former Popular Front of India president E Abubacker. He was arrested by the agency during its crackdown against the banned organisation.
A bench of Justice Siddharth Mridul and Justice Talwant Singh is hearing Abubakar’s appeal against the trial court’s order refusing to release him on medical grounds. The bench also asked the probe agency to file a status report and the opinion of an expert authorized by AIIMS. The court has fixed the matter for hearing on December 14.
The court said that requisite medical treatment would be provided to the accused. However, his plea that he should be sent to house arrest was rejected. We are not inclined to do so, the bench said. AIIMS is a premier hospital in the country. If you are using this as an excuse for house arrest then we are not allowing it. We are only concerned about his medical condition.
Advocate Adit Pujari, appearing for the petitioner, argued that Abubakar was suffering from cancer and Parkinson’s disease. But the trial court rejected his plea. He said that as per the records the accused has been given a very long date to get the test done at AIIMS but there is an urgent need in this case. Expressing displeasure over the long date, the court said where is the diagnosis and treatment? He can’t wait for the scans until 2024.
It is not that he will wait till 2024. It certainly can’t wait until 2024. The court clarified that it is not considering the merits of the case as well as any prayer for granting regular bail to the accused at this stage. The bench said that they are hearing the appeal for medical treatment and the accused can approach the trial court to seek regular bail.
